This includes, without limitation, industry research reports, digital offerings, and the subscription-based Intelligence platform.

By accessing the Website or purchasing and using any of our products or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must refrain from accessing the Website or using any of our products or services.

Definitions

For the purposes of these Terms, the following definitions shall apply:

  • “Client,” “Subscriber,” or “You” refers to any individual or legal entity that purchases, accesses, or uses BMI’s products or services.
  • “Content” means all information, data, analyses, reports, charts, dashboards, and other materials provided or made available by BMI.
  • “Order” refers to any purchase placed by the Client through the Website or through BMI’s sales and contracting process.

Orders, Pricing, and Payment Terms

  • Order Placement: Orders may be submitted through the Website or placed directly with BMI’s authorized sales representatives. All orders are subject to BMI’s review, acceptance, and formal confirmation.
  • Payment Terms: Unless otherwise expressly agreed in writing, full payment is required prior to the delivery of any reports or activation of subscription access. Payments shall be made in the currency specified on the applicable invoice.
  • Taxes: All prices exclude applicable taxes. Any taxes, duties, or statutory levies imposed in connection with the purchase shall be borne solely by the Client and added in accordance with applicable law.
  • Refunds and Cancellations: Given the nature of the data-driven and digital products provided, all sales are final. Once a product has been delivered, no cancellations, exchanges, or refunds shall be permitted.

Report Delivery

Reports and associated deliverables will be delivered electronically—via email or secure cloud access—within the mutually agreed timelines, commencing upon receipt of full payment or a confirmed purchase order.

Intellectual Property Rights and Permitted Use of Content

  • Ownership: All content, reports, data, and related materials provided by Business Market Insights (BMI) are protected under applicable copyright and intellectual property laws and are either owned by or licensed to BMI Knowledge Services Pvt. Ltd.
  • Permitted Use: Clients are granted a limited, non-exclusive, non-transferable, and revocable license to use the purchased content strictly for their internal business purposes.
  • Restricted Use: Unless expressly authorized in writing by BMI, Clients shall not:
    • Sell, sublicense, distribute, copy, or reproduce any content;
    • Share access credentials or provide platform access to unauthorized individuals;
    • Modify, adapt, or create derivative or competing products or services; or
    • Use the Website or platform in any illegal or unauthorized manner.
  • Breach and Remedies: Any violation may result in immediate suspension or termination of access and may expose the Client to civil or criminal liability.

Website Usage and Content Disclaimer

  • Informational Purpose: Website content is provided in good faith for general informational purposes only. BMI makes no warranties regarding accuracy or completeness.
  • Limitation of Liability: To the fullest extent permitted by law, BMI shall not be liable for any direct or indirect losses arising from use of the Website or content. Nothing limits liability for death or personal injury caused by negligence.
  • User Communications: By submitting information on the Website, you consent to being contacted by BMI via telephone or email.

Data Protection and Privacy (GDPR)

Confidentiality

All purchased reports and subscription-based data are confidential. Clients shall not disclose or share any non-public information without prior written consent from BMI.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

Amendments

BMI reserves the right to amend these Terms at any time. Updated Terms will be effective upon publication on the Website. Continued use constitutes acceptance of the revised Terms.
